A disciplinary hearing for Ian Evans, Ospreys lock forward, will be held in Edinburgh on Thursday afternoon. The independent RaboDirect PRO12 Disciplinary Committee appointed is comprised of John Kirk (chairman), Paul Minto (both Scotland) and Dr Barry O’Driscoll (Ireland).

Ian Evans was given a red card by the referee (John Lacey, Ireland), after receiving two yellow cards in the RaboDirect PRO12 match between Benetton Treviso and Ospreys on Friday 31 August.

talk about a wishy-washy ruling.. the 2 cards wasn't sufficient punishment, but they decided not to suspend him just give him a formal reprimand. ->

I reckon that the slap on the wrist was a pragmatic decision - to have suspended him for another game would have been harsh, so they did something cosmetic instead.

Am I right in saying that the player has to meet the costs of the hearing - including Barry O'Driscoll's travelling expenses from Dublin in this case? Because if so, that'll hurt Evans a lot more than the slap on the wrist.

No mention of costs in the press release .. but usually when a finding is against a player they would be obliged to pay the costs.

The threshold for a citing (now made explicit in the Regulations) is the offence a red card offence. A shed load of non-red card offences won't meet that, for all that each individually could be worth a yellow after the third one, because each one looked at on its own won't meet the threshold.

It is a gap, because you're right that lots of low-grade niggly stuff IS worse than two lads in a fair-go, stand-up fair fight. But as it stands, that's that.

result from Varley's hearing:
At a hearing today in Edinburgh, the replacement hooker from Munster, Damien Varley, appeared before an independent RaboDirect PRO12 Disciplinary Committee comprising of Paul Minto (Chairman), John Kirk and Rob Flockhart (all from Scotland), following a red card which had been issued during the Ospreys v Munster RaboDirect PRO12 match played on Saturday 29 September.
Having listened to the testimony and reviewed all of the evidence available, the Committee decided to uphold the red card issued by the Referee, but believed that the offence did not warrant further sanction being imposed. However, they did warn the player as to his future conduct and the reckless nature of the incident.
The player is therefore free to resume playing with immediate effect, and also has the right of appeal.

This is unsatisfactory to me. Either he really did it, in which case he should be binned for several weeks, or the AR fecked up and Varley is innocent (seems to be a whiff of the latter about this decision IMO), in which case the red card should be rescinded.

Three citings and two red cards will proceed to independent disciplinary hearings arising from Round 1 of the Heineken Cup and Amlin Challenge Cup.



ANDY HAZELL - RED CARD
Gloucester Rugby flanker Andy Hazell (No 7) will appear before a Disciplinary Hearing as a result of a red card issued during the Amlin Challenge Cup Pool 1, Round 1 match against Mont de Marsan at Stade Guy Boniface on Thursday, 11 October 2012.Hazell was shown a red card in the 55th minute by referee Neil Hennessy (Wales) for striking Mont de Marsan replacement Sebastien Ormaechea (No 23) in contravention of Law 10.4(a).
Roger Morris (Wales) has been appointed as the independent Judicial Officer. Following a request from Gloucester Rugby for a postponement, the hearing will take place on Thursday, 25 October following Round 2 games. Hazell will be ineligible to play until the disciplinary process has been completed.
Gloucester Rugby referred a number of incidents from the match to the Citing Commissioner, John West (Ireland), for consideration. The Citing Commissioner determined that there was no evidence to support any citings from this match.
Law 10.4 (a) Striking another player with the hand, arm, fist or knee
Under the IRB Recommended Sanctions for Offences Committed within the Playing Enclosure:
Law 10.4(a), striking with the hand, arm or fist carries the following penalties: Lower End: 2 weeks; Mid Range: 5 weeks; Top End: 8+ to 52 weeks.

ERC has received a Citing Complaint against Glasgow Warriors wing, Tommy Seymour (No 14), following the Heineken Cup Pool 4, Round 1 match against Northampton Saints on Sunday, 14 October 2012.
Seymour is alleged to have carried out a dangerous tackle on the Northampton Saints wing, Vas Artemyev (No 11), during the second half of the match at Franklin's Gardens.
The complaint was made by Citing Commissioner, Yves Thieffine (France).
The independent Judicial Officer appointed to hear the complaint is Simon Thomas (Wales), and the hearing will take place on Thursday, 18 October 2012.
Law 10.4 (j) - Lifting a player from the ground and either dropping or driving that player's head and/or upper body into the ground whilst the player's feet are off the ground.
Under the IRB Recommended Sanctions for Offences Committed within the Playing Enclosure, Law 10.4 (j) carries the following penalties: Low End: 4 weeks; Mid Range: 8 weeks; Top End: 12+ to 52 weeks. Note that under the new 'IRB Sanctions for Foul Play' table that was introduced this season, the entry point for sanctions for tip tackles was increased by 33 per cent.

Hines is alleged to have stamped on Scarlets wing, Morgan Stoddart (No 11), during the first half of the match. The complaint was made by Citing Commissioner, John Cole (Ireland).
The independent Judicial Officer appointed to hear the complaint is Simon Thomas (Wales), and the hearing will take place on Thursday, 18 October 2012.
Law 10.4 (b) A player must not stamp or trample on an opponent.
Under the IRB Recommended Sanctions for Offences Committed within the Playing Enclosure, Law 10.4 (b) carries the following penalties: Low End: 2 weeks; Mid Range: 5 weeks; Top End: 9+ to 52 weeks.

Bordeaux-Beglès forward Sisa Koyamaibole (No 8), has been suspended for 12 weeks following an independent Disciplinary Hearing in Dublin today, Wednesday, 17 October, arising from the Amlin Challenge Cup Round 1 match against London Irish at Stade André Moga on Saturday, 13 October 2012.




Koyamaibole was alleged to have committed an act contrary to good sportsmanship in that he bit London Irish replacement Declan Danaher (No 20), during the second half of the match. The complaint was made by Citing Commissioner, John West (Ireland).The independent Judicial Officer, Antony Davies (England), heard evidence and submissions from Koyamaibole, by conference call, who accepted that he had committed an act of foul play contrary to good sportsmanship.
The player was represented at the hearing in Dublin by Bordeaux-Beglès, Director of Rugby, Raphael Ibenez. The Judicial Officer also heard evidence and submissions from ERC Disciplinary Officer, Roger O'Connor and from Declan Danaher by conference call.
The Judicial Officer upheld the citing complaint, concluding that Koyamaibole had committed an act contrary to good sportsmanship in that he bit his opponent.
Employing the IRB recommended sanctions for Law 10.4(m), the Judical Officer determined that the offence, although intentional, had caused minimal injury, and was at the low-end entry point of 12 weeks. After considering any mitigating and aggravating factors he decided that the entry point was sufficient and imposed a suspension of 12 weeks.
Koyamaibole will be free to play on 7 January 2013. Both the player and ERC have the right to appeal the decision.

Tommy Seymour will miss Round 2

The Glasgow Warriors wing, Tommy Seymour (No 14), has been suspended for one (1) week following an independent Disciplinary Hearing in Dublin today, Thursday, 18 October 2012, as a result of a citing made against him from the Heineken Cup Pool 4, Round 1 match against Northampton Saints on Sunday, 14 October 2012.




The complaint was made by Citing Commissioner, Yves Thieffine (France), for an alleged dangerous 'tip' tackle on the Northampton Saints wing, Vasily Artemyev (No 11), during the second half of the match at Franklin's Gardens.The independent Judicial Officer Simon Thomas (Wales), heard evidence and submissions from Seymour, who pleaded not guilty to foul play, and from Glasgow Warriors, Director of Rugby, Gregor Townsend and Seymour's legal representative.
He also heard submissions from ERC Disciplinary Officer, Roger O'Connor.
The Judicial Officer upheld the citing complaint and employing the IRB recommended sanctions for Law 10.4(j), he decided that the offence warranted a low-end entry point of four (4) weeks.
However, when considering the very specific circumstances of the tackle, the Judicial Officer felt that a four week suspension would be "wholly disproportionate". Accordingly, and based on the presence of a number of mitigating factors, including Seymour's clean record, the Judicial Officer reduced the sanction to a one (1) week suspension.
Seymour will be free to play on 22 October 2012. Both ERC and the player have the right to appeal the decision.

i) Citing Commissioner
a) Citing Commissioners are appointed by ERC for all Heineken Cup and all televised Amlin Challenge Cup matches and shall be entitled to cite a Player for any act or acts of Foul Play that in the Citing Commissioner's opinion warranted a red card.
b) For such matches Clubs will not have the power to cite a player but may refer incidents to the Citing Commissioner within 26 hours of the start of the match.
c) The Citing Commissioner will have 50 hours from the start of the match to make a citing. In certain circumstances this deadline can be extended.
d) The ERC Disciplinary Officer, Roger O'Connor may forward the submitted Citing to a Citing Officer to determine whether there are sufficient grounds for the citing to progress.
e) The Disciplinary Officer will then bring a charge against the cited player.
(ii) Disciplinary Hearing
a) The independent Judicial Officer is chosen by the Chairman of the independent Disciplinary Panel, Professor Lorne Crerar.
b) ERC's Disciplinary Officer, Roger O'Connor, presents the case against the player.
c) Both parties to the hearing (ERC and the player) have the right to appeal decisions of the independent Disciplinary Hearing. Appeals must be lodged within 3 working days of receiving the full written decision of the independent Judicial Officer.
d) The full written decision of the independent Judicial Officer will be available on www.ercrugby.com/disciplinenews when the disciplinary process is complete

Stoddart in action in Heineken Cup

The red card issued to Scarlets wing, Morgan Stoddart (No 11), during the Heineken Cup Pool 5 match between ASM Clermont Auvergne and Scarlets at Stade Marcel Michelin on Saturday, 13 October has been deemed to be sufficient punishment, and Stoddart is free to play with immediate effect.




Stoddart was shown a red card by referee, Peter Fitzgibbon (Ireland), in the 37th minute of the match for a second yellow card.

The independent Judicial Officer, Antony Davies, considered the matter by means of written submissions. He concluded that neither offence involved foul play directed at an opponent and that no additional sanction was necessary.

Notes(i) Red Cards
a) The case of any player sent off in Heineken Cup or Amlin Challenge Cup games shall be adjudicated by an independent Judicial Officer as soon as is practicable.
b) Until the hearing the player is ineligible to play in any tournament.

Severe suspension for the second line of the ASM Clermont Auvergne that scoop 6 weeks for a "stamping" on the Scarlets wing Morgan Stoddart during the first day of HCup. To 5 weeks of suspension related gesture itself called "stamping" medium severity (as recommended by the Coast IRB) and not "rucking", add an extra week to recurrence of similar acts committed by Nathan Hines during previous seasons. ASM Clermont Auvergne not recover the license of its second line as Scottish weekend of December 1, 2012 (moving to Toulouse).

Tolofua is alleged to have carried out a dangerous tackle on the Benetton Treviso replacement, Fabio Semenzato (No 22), in contravention of Law 10.4(j) during the second half of the match at the Stadio Comunale di Monigo. The complaint was made by Citing Commissioner, Buster White (England).

Tolofua was shown a second yellow card, resulting in a red card, for the alleged dangerous tackle by referee, Leighton Hodges (Wales).

The independent Judicial Officer appointed to hear the citing complaint and the matter of the red card is Roger Morris (Wales) and the hearing will take place in Dublin on Thursday, 25 October 2012.

5. Discipline

(i) the case of any player sent off shall be adjudicated upon by an independent Disciplinary Committee.

(ii) Citing commissioners are appointed by ERC for all Heineken Cup and all televised Amlin Challenge Cup matches and are entitled to make a citing complaint against a player for any act of foul play that, in the citing commissioner's opinion, warranted a red card. For such matches, clubs do not have the power to make a citing complaint against a player but may refer incidents to the citing commissioner.

The Disciplinary Officer may forward any citing complaint to a citing officer (or 'gatekeeper') to determine whether there are sufficient grounds for the citing complaint to proceed. If a citing complaint is to proceed, the Disciplinary Officer will then bring a complaint against the cited player before an independent judicial officer.
